These General Terms of Sale ("Terms") govern the sales of digital content made on the Kaizen shop available at https://donate.kaizen-dayz.fr/.
The shop and the content offered are operated by:

Hereinafter "Kaizen" or "the Seller".
These Terms set out the rights and obligations of Kaizen and of any natural person acting for non-professional purposes ("the Customer") when buying digital content (skins and skin packs) offered on the Kaizen shop.
During a promotional operation, some packs may also give a promotional advantage: one or more entries to a prize draw, under the rules of the operation concerned, available from the page of the operation.
Draw entries are a promotional advantage attached to the packs concerned. They are not a product sold separately, have no monetary value of their own, and cannot be resold, transferred, exchanged or refunded separately from the pack they are attached to.
The main characteristics of each product (skins included, compatible items, price and, where applicable, promotional entries) are shown on its product page and repeated in the recap displayed before payment.
The skins are the digital content purchased. Draw entries are a temporary promotional advantage attached to the purchase of some packs during an operation.
The skins are digital content intended exclusively for use on the DayZ servers operated by Kaizen and/or No Man's Z (NMZ) that are compatible with the Kaizen skin system, namely:
The skins are not available on Namalsk, including the NMZ Namalsk server, and never will be.
The launch date of KAIZEN Nasdara is provisional. If it is postponed, the new date is shown on the shop; the skins remain usable on the other compatible servers.
Each skin applies to the in-game items shown on its product page. Buying a skin gives no right to use it on another DayZ server, a third-party server or another platform.
Skins are not Steam items, are not stored in the Customer's Steam inventory and cannot be sold on the Steam Community Market. They are a digital right of use limited to the compatible Kaizen/NMZ environment.
Using the shop requires signing in with a Discord account. To buy a pack and receive it, the Customer must also have linked a valid SteamID to their account.
The Customer is responsible for the accuracy of the SteamID. Before paying, they must check that:
Once the order is confirmed and the content granted to the SteamID given at purchase, the skins cannot be voluntarily transferred to another SteamID, unless such a change is needed to correct an error attributable to Kaizen or the law requires another solution. A SteamID error made by the Customer therefore does not automatically give a right to a transfer. Kaizen may nevertheless examine exceptional situations case by case, without this being a contractual obligation to transfer.
The prices applicable are those shown on the shop when the order is placed. They are in euros. VAT not applicable under Article 293 B of the French General Tax Code.
The price shown before the order is confirmed is the total price the Customer actually pays. No additional cost can be added after the order is confirmed without having been brought to the Customer's attention beforehand.
The Customer selects the pack they want. Before payment, a recap lets them check in particular:
The Customer must read and accept these Terms, with a box that is not ticked in advance, before confirming the order. The confirmation button clearly states that the order implies an obligation to pay ("Order and pay"). Final confirmation of the payment implies an obligation to pay.
Before payment, the Customer gives a valid e-mail address, which is required. After the payment is confirmed, Kaizen sends to this address a confirmation of the order on a durable medium, as required by law. This confirmation includes the content of the order, its price and the consents given by the Customer, with these Terms and, where applicable, the rules of the promotional operation attached. It can also be viewed and printed at any time from the "My account" area of the shop. The e-mail address is used only to manage the order.
Once the payment is confirmed, the rights to the skins included in the pack are granted to the SteamID given by the Customer and recorded in the Kaizen system. The skins can be used right away on No Man's Z x Kaizen Chernarus and KAIZEN DeathMatch, and on KAIZEN Nasdara once this server goes online (Article 4), subject to their availability under Article 12.
When, for a given offer, the skins can only be used in game from a later date, that date is an essential characteristic of the offer: it is shown to the Customer before ordering and must be accepted by them, with a separate box, before the order is confirmed.
Under the French Consumer Code provisions on distance contracts, consumers in principle have a legal withdrawal period of fourteen days.
The supply of digital content not provided on a tangible medium may however lead to the loss of the right of withdrawal under Article L.221-28 of the French Consumer Code, in particular when performance begins before the end of the legal period, subject to the legal conditions.
When Kaizen intends to start performing the contract before the end of the legal withdrawal period, the Customer must in particular:
Accepting these Terms is not, on its own, the required express consent.
When a right of withdrawal remains, the Customer can exercise it with the "Withdraw from the contract" function available from the "My account" area of the shop, for each order concerned, or by any other unambiguous statement sent to Kaizen within the legal period (in particular by e-mail to contact@kaizen-dayz.fr). Kaizen acknowledges receipt of the withdrawal and refunds the Customer, with the payment method used, within fourteen days of being informed.
When the legal conditions for losing the right of withdrawal are actually met, the Customer can no longer exercise it.
These provisions in no way limit the mandatory rights of consumers, in particular regarding lack of conformity.
When an order is validly cancelled, refunded or withdrawn from under the applicable law before the draw, the promotional entries attached to that order are automatically cancelled. An entry cannot survive independently of the contract that created it when that contract is validly annulled.
If an order is validly cancelled after the draw and before the prize is delivered, and that order allowed the Customer to be selected as the winner, Kaizen may hold a new draw when the cancellation of the order legally removes the attached promotional advantage.
This provision never deprives consumers of a right of withdrawal, guarantee or refund they legally have.
The digital content sold by Kaizen benefits from the legal guarantee of conformity applicable to digital content and digital services. For a one-off supply, Kaizen is liable for any lack of conformity existing at the time of supply and appearing within two years of it, under the conditions of the French Consumer Code.
The content must in particular match its description and offer the functions, compatibility and characteristics provided for in the contract. In case of lack of conformity, consumers have the rights provided for by Articles L.224-25-1 et seq. of the French Consumer Code.
Box — Legal guarantee
Consumers are entitled to the legal guarantee of conformity when a lack of conformity appears within two years of the supply of the digital content, for content supplied once. During that period, consumers only have to establish the existence of the lack of conformity, under the conditions set by law.
The legal guarantee of conformity entitles consumers in particular to have the digital content brought into conformity free of charge, without undue delay and without significant inconvenience. In the cases provided for by law, consumers can obtain a price reduction or the termination of the contract.
These rights result in particular from Articles L.224-25-1 to L.224-25-31 of the French Consumer Code. Where applicable, consumers also benefit from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code.
The skins are meant to be used on online game servers. The Customer acknowledges that these servers may be temporarily interrupted for maintenance, updates, wipes or fixes, or because of a technical incident, a provider failure, a cyber attack, a DayZ update or an external event reasonably beyond Kaizen's control.
These temporary interruptions do not remove the applicable legal guarantees. Kaizen undertakes to use reasonable means to restore its services in case of an incident for which it is responsible.
Buying a pack transfers no intellectual property right in the artwork, files, textures, models or technical elements used. The Customer only receives a personal right to use the digital content in the compatible Kaizen/NMZ environment.
Unless authorised in writing by Kaizen, the following are prohibited in particular:
DayZ is a trademark of Bohemia Interactive a.s.; Steam is a trademark of Valve Corporation; Discord is a trademark of Discord Inc. The Kaizen shop is not affiliated with, endorsed or sponsored by these companies.
To manage orders and promotional operations, Kaizen processes only the data strictly needed, in particular: Discord identifier; Steam identifier (SteamID); e-mail address given for the order confirmation; order information; date and amount of the transaction; pack bought; number of entries granted; consents given before payment; data needed to prevent fraud; information needed to deliver a prize.
The data is used to manage orders, grant the content, run promotional operations, prove the consents, prevent fraud, keep the accounts and meet Kaizen's legal obligations.

Kaizen is liable for the performance of its obligations under French law. No provision of these Terms may exclude or limit a mandatory right granted to consumers.
Kaizen cannot however be held liable for a malfunction directly caused by a technical environment of the Customer that is incompatible with the requirements given before the sale, subject to the applicable legal provisions.

Using Discord does not deprive consumers of the other means of contact and remedies provided for by law.
In case of a dispute, the Customer is invited to contact Kaizen first to look for an amicable solution. For a dispute about a purchase in the shop that was not settled after a written complaint to Kaizen, consumers can refer the matter free of charge, under Articles L.612-1 et seq. of the French Consumer Code, to the consumer mediator:

These Terms are governed by French law. This clause does not deprive a consumer living in another State of the mandatory protective provisions they may benefit from under the applicable rules.
